Terms of Service

Last updated [To be completed: effective date]
The short version: Fibral prescribes how much to lift, and that is training guidance from software rather than medical advice - read section two before you follow it. Your training history is yours, you can export it or delete it whenever you want, and subscriptions are billed and cancelled through the app store you bought from.

01The agreement

These terms are a contract between you and [To be completed: legal entity name and company number] (“Fibral”, “we”). They cover the Fibral mobile app, this web dashboard, and the API behind them. By creating an account or using Fibral you accept them. If you do not, do not use Fibral.

How we handle your data is set out separately in the Privacy Policy, which forms part of this agreement.

You must be at least 16 years old, or older if [To be completed: minimum age in the governing jurisdiction] requires it, and able to enter a binding contract.

02Fibral is not medical advice

Fibral tells you how much weight to lift, for how many reps, how often, and when to add more. That is training guidance produced by software. It is not medical advice, not physiotherapy, not a diagnosis, and not a substitute for a qualified professional who can see you.

Resistance training carries a real risk of injury. Before you start, and before any significant change in what you are doing, talk to a physician or another qualified healthcare provider - especially if you have or suspect a heart condition, high blood pressure, a joint or spinal problem, a hernia, an eating disorder, if you are pregnant or recently post-partum, if you are recovering from illness, injury or surgery, or if you are taking medication that affects your heart rate, blood pressure or balance.

  • Stop and seek help if you feel chest pain, dizziness, faintness, sharp or unfamiliar joint pain, numbness, or anything that does not feel like training fatigue. A program from Fibral is never a reason to keep going.
  • You are responsible for how you lift. Technique, warm-up, spotters, safety pins, the condition of your equipment, and the judgement to stop a set are yours. Fibral cannot see you and cannot know whether a rep was safe.
  • Injuries you describe are accommodated, not treated. If you tell the coach about a bad shoulder it will work around it. That is a programming adjustment, not clinical management, and it is not clearance to train an injury that a professional has told you to rest.
  • The numbers depend on what you tell it. Loads are computed from the maxes, body weight and history you provide and log. Wrong inputs produce wrong prescriptions.

You use Fibral voluntarily and you accept the ordinary risks of resistance training. Nothing in this section limits any liability that cannot lawfully be limited, including for death or personal injury caused by our negligence.

03What the coach is, and what it is not

Fibral’s coach is built on a large language model. Its output is validated by our own checks before you see it, but it is generated, not authored by a human, and it can be wrong, incomplete, or confidently mistaken. Treat it as a well-informed starting point that you are free to override, not as an instruction.

The science library shows where a programming rule came from. A citation is a statement about the source of a general rule, not a claim that a study was run on someone like you, or that its result guarantees your result. Published research describes averages; you are not an average.

Nothing about Fibral’s programming is promised to produce a particular outcome. Strength, size, body composition and performance depend on sleep, nutrition, stress, genetics, consistency and luck, most of which the app cannot see.

04Your account

  • Give accurate sign-up details and keep your password to yourself. You are responsible for what happens under your account.
  • One account per person. Accounts are not transferable and not to be shared.
  • Tell us promptly at [To be completed: support contact email address] if you think someone else has access.
  • You can delete your account at any time, from Settings. Deletion is immediate and irreversible, and it does not cancel a store subscription.

05Subscription and billing

Fibral has a free tier. Paid features are sold as an auto-renewing subscription: [To be completed: plan names, prices and billing periods as configured in the stores], with a [To be completed: trial length] free trial for new subscribers.

  • Where you pay. Purchases are made through the Apple App Store or Google Play and are charged to that account. We never see your payment details.
  • Renewal. A subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. Prices are set per storefront and may differ by country and by currency.
  • Trials. An unused trial converts to a paid period unless you cancel before it ends. Cancelling during a trial keeps your access until the trial’s last day.
  • Cancelling. Cancel in the App Store or Play Store subscription settings. Deleting the Fibral app or your Fibral account does not cancel billing.
  • Refunds. Refunds are handled by the store you bought from, under its policy. Where local consumer law gives you a right to cancel or a refund, that right stands regardless of the store’s policy.
  • Price changes. We will tell you before a price change takes effect, and you can cancel before it applies.
  • If a payment fails, the store retries for a period. Access continues during that window and lapses if it is not resolved.

Losing paid access never deletes your training history. Your log and your logged sets stay readable and exportable on the free tier.

06Fair use of the coach

The coach costs real money to run per message, so a subscription includes a generous but finite monthly allowance of AI requests. If you reach it, logging, your existing program and export keep working; new AI requests resume at the start of the next month.

We may adjust that allowance, and we will not adjust it quietly. This is a limit on automated and outlier usage, not a limit on training seriously.

07Your data and your content

Your training history, your notes, and your messages to the coach are yours. We do not claim ownership of them.

You grant us the licence we need to run the service for you: to store, process, transmit and display that content, and to send the parts described in the Privacy Policy to our AI provider in order to answer your requests. The licence exists only to operate Fibral, it is not transferable beyond our processors, and it ends when you delete the content or your account.

Programs Fibral generates for you are yours to use, print, and follow. The software, the design, the research library and its curated notes remain ours.

If you send us feedback or a feature idea, we may use it without owing you anything for it.

08Acceptable use

Do not:

  • create accounts automatically, in bulk, or to get around a limit, a trial or a ban;
  • scrape, bulk-download or redistribute the research library, or use it to build a competing corpus or to train a model;
  • reverse engineer, decompile, or probe the service beyond what the law expressly permits, or attempt to extract prompts, keys or another user’s data;
  • interfere with the service, its rate limits, or anyone else’s use of it;
  • use the coach for anything other than training questions, or to try to obtain medical, legal, or other professional advice from it;
  • resell or sublicense access to Fibral, or present its output as the work of a qualified professional who has assessed the client;
  • use Fibral where doing so would break the law.

Coaches and trainers are welcome to use Fibral in their own practice. You remain responsible for your clients, for your own professional judgement, and for anything you hand them.

09Availability and changes

Fibral logs your training on your device first and syncs when it can, so an outage should not stop you training. Even so, the service is provided as-is and we do not promise it will be uninterrupted or error-free.

We may change, add or remove features. If we remove something you rely on or discontinue the service, we will give reasonable notice and you will be able to export your data before it goes.

10Disclaimer

To the fullest extent the law allows, Fibral is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the coach’s output is accurate, complete, or suitable for you.

Some jurisdictions do not allow these exclusions. Where that is so, this section applies only as far as it lawfully can, and your statutory consumer rights are unaffected.

11Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data, or lost training progress.

Our total liability arising out of or relating to Fibral is limited to the greater of the amount you paid us in the twelve months before the claim, or [To be completed: minimum liability floor, e.g. USD 100].

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, for fraud, or under any non-excludable consumer guarantee.

12Indemnity

If your use of Fibral, your breach of these terms, or your infringement of someone else’s rights causes a third-party claim against us, you agree to cover the reasonable costs and damages that result, so far as the law allows.

13Suspension and termination

You can stop using Fibral at any time and delete your account from Settings.

We may suspend or close an account that breaches these terms, that is being used to abuse the service, or where we are legally required to. Where it is reasonable to do so we will warn you first and give you a chance to export your data. If we close your account without cause, we will refund the unused part of a paid period.

14App store terms

If you installed Fibral from the Apple App Store, the following also applies and prevails over anything inconsistent above:

  • This agreement is between you and Fibral only, not Apple. Fibral alone is responsible for the app and its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform are Fibral’s responsibility.
  • Fibral, not Apple, is responsible for addressing any claim that the app or your use of it infringes intellectual property rights, fails to conform to legal or regulatory requirements, or gives rise to product liability or consumer protection claims.
  • You represent that you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government prohibited or restricted party list.
  • Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

If you installed Fibral from Google Play, Google’s Play Terms of Service also apply to that distribution and to any purchase made through it.

15Changes to these terms

We may update these terms. If a change materially affects your rights we will tell you in the app before it takes effect, and continuing to use Fibral after that date means you accept it. If you do not, cancel and delete your account.

16Governing law and disputes

These terms are governed by the law of [To be completed: governing jurisdiction], and disputes will be heard in the courts of [To be completed: venue for disputes], except that if you are a consumer you keep the protection of the mandatory laws of the country you live in, and may bring proceedings there.

[To be completed: decide whether an arbitration clause or class-action waiver applies, and whether it is enforceable in the chosen jurisdiction]

If any part of these terms is unenforceable, the rest stays in force. Not enforcing something once does not waive it.
